Terms of Use
These Terms of Use cover your use of rushhournj.com (the “site”). The site is run by Nexverta LLC, which runs Rush Hour: The Billiards Bar at 960 US-9, South Amboy, NJ 08879. By using the site you agree to these terms; if you don’t agree, please don’t use it.
The Rush Hour Rewards program and the RH Rewards app have their own Rewards Program Terms, which add to these.
Using the site
- You may use the site for your own, personal and non-commercial purposes.
- You must be 13 or older to send us information through the site.
- At the venue, alcohol is served only to guests 21 or older with valid ID. Our house rules apply when you visit.
Hours, prices and events
Our hours, menus, prices, pool rates, events and promotions can change without notice. We work to keep the site accurate, but mistakes happen. The prices and rules posted at the venue, and those charged at our register, are the ones that apply.
- Pool tables: first come, first served. We don’t take table reservations.
- Private events: these are booked under a separate agreement. An inquiry sent through the site isn’t a booking until we confirm it in writing.
What you send us
Please make sure what you send through our forms is accurate and yours to share. Don’t send other people’s information without their permission.
If you send us ideas or feedback, we may use them without any obligation to you.
Our Privacy Policy explains how we handle what you send.
Our content
Everything on the site belongs to Nexverta LLC or its licensors, including:
- the Rush Hour name, logos and wordmark;
- the photography, video, text and design.
Please don’t copy, reuse or change it without our written permission, except to share links to our pages.
What you may not do
- Break the law, or help anyone else break it, through the site.
- Try to get into parts of the site, our systems or other people’s accounts that aren’t meant for you.
- Disrupt the site, overload it, or get around its security.
- Scrape or harvest the site or its data, except as search engines do.
- Pretend to be someone else, or send spam or harmful code.
Other websites
The site links to services we don’t control, such as Google Maps and our social media pages. Their own terms and privacy policies apply there, and we aren’t responsible for them.
Disclaimers
The site is provided “as is” and “as available”. As far as the law allows, we make no warranties of any kind, express or implied, including that the site will be accurate, uninterrupted or error-free.
Limits on our liability
As far as the law allows, Nexverta LLC isn’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site. Our total liability for any claim about the site is limited to $100.
Some laws, including New Jersey’s, don’t allow certain warranties to be excluded or certain liability to be limited. Where they don’t, those parts of these terms don’t apply to you. Nothing in these terms limits a right you have under New Jersey law that can’t be waived.
Indemnity
If you misuse the site or break these terms and someone brings a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim, as far as the law allows.
Disputes: arbitration and class-action waiver
Please read this section carefully. It affects how disputes are resolved.
- Talk to us first. If you have a problem with us, email [email protected] and we’ll try to fix it. If it isn’t resolved within 30 days, either of us may start arbitration.
- Arbitration. Except as below, any dispute about the site, the Rush Hour Rewards program or these terms will be decided by binding individual arbitration, not in court.
- The American Arbitration Association runs it, under its Consumer Arbitration Rules.
- It takes place in Middlesex County, New Jersey, or by video or phone if you prefer.
- We’ll pay the filing and arbitrator fees that the rules don’t charge you.
- The Federal Arbitration Act governs this agreement to arbitrate.
- Small claims. Either of us may instead bring an individual claim in small claims court.
- No class actions. You and we may each bring claims only for ourselves, not as a plaintiff or class member in any class, collective or representative action. Each of us also waives a jury trial.
- Your right to opt out. You can opt out of this arbitration agreement within 30 days of first agreeing to these terms (or to the Rewards Program Terms). Email [email protected] with the subject “Arbitration opt-out”, and include your name and the phone number or email you use with us.
- If part of this fails. If the class-action waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
Governing law
These terms are governed by the laws of New Jersey, apart from its conflict-of-law rules. Matters that aren’t arbitrated will be heard in the state or federal courts in Middlesex County, New Jersey.
Changes to these terms
We may update these terms. The new version takes effect when we post it here with a new date. If you keep using the site after that, you accept the update. If a part of these terms turns out to be unenforceable, the rest still applies.
