Privacy Policy
This policy explains what Nexverta LLC collects when you visit Rush Hour: The Billiards Bar, browse our website at rushhournj.com, fill in one of our forms, or use the RH Rewards app (Rush Hour Rewards), and how we use and protect that information. Nexverta LLC runs Rush Hour: The Billiards Bar at 960 US-9, South Amboy, NJ 08879. “We”, “us” and “our” mean Nexverta LLC.
The short version
- We collect what we need to run the venue, the website and the rewards program, and nothing for advertisers.
- We don’t sell your personal information, and we don’t share it for targeted advertising.
- We only send marketing texts if you opt in. Reply STOP to any of them to stop.
- You can delete your rewards account in the app at any time.
- Questions or requests: [email protected].
What we collect
When you use our website
Our forms ask for what each one needs, and nothing more:
- VIP list: your name, email address and, if you choose, your phone number.
- Private events: your name, email, optional phone and company or group name, plus the event details you give us (the type of event, a preferred date, how many guests, packages and notes).
- Pool leagues: your name, email, optional phone, the league you’re interested in and whether you have a team.
- Questions: your name, email, optional phone and your message.
If you email us, we have whatever you send us.
When you join Rush Hour Rewards
- Your mobile number, to sign you in with a one-time code and to match your visits.
- Your first and last name.
- Your birthday, to confirm you meet the program’s minimum age (13) and to send your birthday treat.
- Your email address, if you choose to give it.
- Your choices about notifications and marketing texts.
- A member number that we create for you.
When you visit and earn points
When you scan or type in a receipt in the app, we use its check number, date and total to find the check in our point-of-sale system (Toast); the camera reads the receipt on your phone and the photo isn’t sent to us. If staff add your phone number to a check at the register, Toast links that check to your account. Either way, we receive the check’s details, such as:
- its date, time and number;
- the amounts (subtotal, tax and tip);
- the items on it.
When a reward certificate is redeemed, we record which check it was used on.
Automatically
- Website: like most websites, our servers and our security provider (Cloudflare) receive your IP address, browser type and the pages you visit. Google Analytics measures how the site is used, through cookies. Our Cookie Policy has the details.
- App: your device type, operating system and app version. If you allow notifications, we also get a push token. Our servers see IP addresses, which we use to protect sign-in from abuse.
How we use it
- To run Rush Hour Rewards: your account, points, certificates, birthday treats, missed checks and history.
- To keep accounts safe: we sign you in with one-time codes, limit repeated attempts, and spot and stop fraud and misuse.
- To answer you: your questions, event inquiries and league interest.
- To send the messages you ask for: sign-in codes, “points landed” and certificate notices. Offers and specials go out only if you opted in.
- To improve the website and app, using statistics about how they’re used.
- To run the business and meet our legal duties, such as accounting, tax and responding to lawful requests.
Text messages
We send two kinds of texts:
- Sign-in codes. When you ask to sign in to the app, we text a one-time code to the number you entered.
- Offers and specials, only if you opt in. You choose this in the app (“Text me game-day specials and offers”). Expect up to 4 messages a month.
- Costs: message and data rates may apply.
- Stopping: reply STOP to stop marketing texts, or turn them off in the app.
- Help: reply HELP.
- Not required: agreeing to texts is never a condition of buying anything.
We do not share or sell your mobile number or your consent to receive texts with any third party or affiliate for their marketing or promotional purposes. This excludes text-messaging originator opt-in data and consent: that information will not be shared with any third parties.
Our texting provider (Twilio) delivers messages on our behalf only. See the text-message terms in our Rewards Program Terms.
How long we keep it
- Rewards account: as long as it’s open.
- When you delete it, we remove your name, phone number, email and birthday from it straight away.
- We keep only de-identified records of points and certificates that our accounting needs. They also keep certificates you’ve already shared working until they expire.
- Form submissions and emails: as long as we need them to answer you and plan events, and up to two years.
- Server and security logs: a short time, usually no more than 90 days.
- Accounting records: as long as the law requires.
Your choices and rights
- See and update your details in the app, under Account → Personal info.
- Delete your rewards account in the app, under Account → Delete account.
- Stop marketing texts: reply STOP, or turn them off in the app.
- Turn off notifications in the app or in your phone’s settings.
- Block or delete cookies in your browser (see the Cookie Policy).
Wherever you live, you can ask us for a copy of your information, or to correct or delete it, by emailing [email protected].
- Your state’s rights: residents of New Jersey and other states with privacy laws may have more rights. These include data portability and opting out of the sale of personal information, targeted advertising and profiling. We don’t sell or target, and we honor these requests for everyone.
- How we handle requests: we’ll confirm a request comes from you (for example, by checking it against your account’s phone number). We respond within 45 days.
- Appeals: if we turn a request down, you can appeal by replying with “Appeal” in the subject.
- No penalty: we won’t treat you differently for using any of these rights.
Children
Our website isn’t meant for children under 13. Rush Hour Rewards requires members to be 13 or older and checks this with your birthday. We don’t knowingly collect personal information from anyone under 13.
If you believe a child under 13 has given us information, email [email protected] and we’ll delete it.
The rewards program never involves alcohol.
How we protect it
How we keep your information safe:
- Information is encrypted in transit (HTTPS).
- Only the staff who need it can see it.
- You sign in with one-time codes instead of passwords.
- Certificate codes are random and work only once.
No system is perfectly secure, so please keep your phone locked and tell us at once if you think your account has been misused.
Changes to this policy
When this policy changes, we’ll post the new version here with a new date. If a change matters to how we use your information, we’ll also tell you in the app, or by email or text where appropriate, before it takes effect.
